MOTORIST AND COWS ON THE ROAD
Robert James Bull, farmer, of Etchells Farm, Church Broughton, brought an action against A.O.Fuller, of the Royal Hotel, Derby, for £42, the value of a cow, which plaintiff alleged defendant ran into with his motor-car and injured it so seriously that it had to be slaughtered. Mr T H Bishton, of Leek, appeared for plaintiff and Mr A R Flint for defendant.- Opening the case for the plaintiff, Mr Bishton said the plaintiff’s cowman was driving 50 or 60 cows out of a field into the road, when the defendant ran into one cow with his motor-car, and knocked it down. He contended that defendant must have been driving at an excessive speed. The cow was struck on the left hind leg, which was broken; two ribs were also broken and its shoulder injured. A veterinary surgeon was called, and ordered the cow to be slaughtered. This was done, and the carcass was sold to a local farmer and butcher for £7. On the following Friday plaintiff and another farmer saw defendant, who told him he regretted what had occurred, and that if a reasonable claim was made it would be paid. Defendant also said: "I didn't think it was hit, because I was only going slowly." Since then, in a letter, defendant said he was absolutely standing still. The cow would now have been of the value of £55. The accident happened at four o'clock on the afternoon of September 11.- Fred Billinge, the cowman, gave evidence, and in cross-examination denied that the defendant told him the cow put its foot under the wheel.- John Archer Wedd, a local butcher and farmer, described the injuries to the cow, and Frank Horton, veterinary surgeon, Tutbury, spoke to finding the cow lying on the grass by the side of the road, with its leg broken, and he ordered it to be slaughtered. - In reply to Mr Flint, witness said he did not consider the cowman could have had much control over the first of the herd of cows coming out of the field. - Plaintiff gave evidence as to the value of the cow, and said it was seven years old and gave four gallons of milk daily. - William Tipper, a neighbouring farmer, who was present at the interview between plaintiff and defendant, said the latter told them he had had to pull the mudguard of the car up. - Mr Flint submitted that there was no evidence of negligence. - The Judge: oh, yes, there is. In my opinion anybody meeting a herd of cows who keeps his car moving so as to run into a cow and knock it down is guilty of negligence.- The defendant gave evidence that he turned into the lane and met a herd of cows. He could not at first see the man at all. He approached the cows very slowly, and by the time he got up to the first cow the car was absolutely standing still. He made a noise with the engine, and the cows pushed one another away from the car, and one got its foot under the wheel; the cow struggled, sat on its rump, and rolled over. He got out of the car, and had to wait some minutes until the man came up. - Replying to the Judge, defendant said he was absolutely certain he had stopped the car, but admitted he did not know how the cow's ribs were broken. - Mr Flint said the position would be intolerable if a motorist had to pull up every time he met cows. He also argued that it was impossible for the cowman to say precisely what happened when he was fifty yards away, and was not in a position to see. The injuries implied that the cow must have been broadside on to the car, and he argued that the injury to the fetlock must have been done by the pinioning of one of the cow's feet under the wheel and its struggling.- Summing up, the Judge said that the evidence was that the car was in motion when it struck the cow. He did not intend to reflect on Mr Fuller’s probity or intelligence. He could not rely upon his evidence, because he did not think he had a clear idea of what happened or that his memory was accurate about what happened. That was not a reflection on his intelligence, because it was rare indeed to find in such cases a witness who had a very accurate recollection of events. He had often seen cases of the negligent driving of cattle on the road, and in this case the man must have been a good deal more than the 50 yards to the rear he said he was. Farmers were entitled to drive cattle along the road, and could not be expected to provide enough men to make them safe. Of all people drivers of cars had the greatest control over the movements of their machines, and in his opinion it was their duty in such circumstances to go so slowly as to be able to stop in a fraction of a second. Some people might think that was an intolerable burden, but if they kept moving they did so at their own risk. - Judgement was given for the amount claimed.11

          In the 1939 Registration, held on 29 September 1939, Robert James Bull was recorded as the first person in the 3 person Household at Arden House, High Street, Tutbury, Staffordshire. Also in the Household were Ida Mary Bull and Gertrude Mary Bull plus 1 officially closed record,

     Robert died on Friday, 7 September 1951, aged 80, in Arden House, Tutbury, Staffordshire, he was survived by his wife, Ida, his Death was Registered at the Lichfield Register Office in the Jul-Aug-Sep Quarter of 1951.14,15

     Probate for Robert's Estate was granted on 10 December 1951 at London.
     Probate Register Entry - " Robert James Bull of Arden House, Tutbury, Staffordshire, died 7 September 1951.
Probate was granted at London on 10 December to David Prince, Farmer and Donald Stevenson Cash, Solicitor.
     Effects = £10,999 5s."16

     Benjamin Bull, son of John Bull and Sarah Ann Pattison, was born in The Abbey (Farm), Leekfrith, Leek, Staffordshire, on Wednesday, 11 November 1874.
     The details from the Birth Certificate are - Entry #224 - Benjamin, Boy, son of John Bull, Farmer and Sarah Ann Bull formerly Pattison. Informant - Sarah Ann Bull, Mother of Leekfrith on 9 December 1874. Registrar - Robert Hulme.1,2

     Benjamin joined the East Yorkshire Regiment, Service No. 3742, and signed the oath of allegiance in Manchester on 14 June 1892 to serve 7 years with the Colours and 5 years in the Reserve. It can only be speculated how it was that he was persuaded to join – perhaps because the family had fallen on hard times or he may have wanted to do something different. His Service Record is revealing. The form which Benjamin has signed as being the truth states that his age was 18 years and 1 month. This however was not true – he was only 17 years and 7 months old. The minimum recruitment age in 1892 was 18 years.

The “Description of Benjamin Bull on Enlistment” also reveals that he did not meet the physical requirements – he was only just tall enough and his weight was only 114 lbs when the requirement was 115 lbs. His chest measurements of minimum 32” and maximum expansion 34 ½” did not meet the required measurements of 34-36”. The Medical Officer declared him fit for the army as a “special” i.e. a recruit who failed to meet the minimum requirements but who, in view of the medical officer, promised to become an efficient soldier.

The “Military History Sheet” reveals that Benjamin first spent 273 days with the regiment training in England. As he was in the 3rd Regiment, this was probably at the Victoria Barracks in Beverley. He also obtained Certificates of Education which had been introduced in the army to induce learning and were linked with promotion in the ranks. Many new recruits were illiterate so it is understandable that Benjamin quickly obtained the third and second class certificates that entailed reading, writing and arithmetic. This meant he could be promoted. On 9 November 1892 he was made a lance-corporal which at that time was not a rank but a trial period before becoming a corporal. On 14 March 1893 he was transferred to the 1st Regiment and sent out by transport ship to Egypt to meet up with the regiment in Alexandria.

Britain had invaded and occupied Egypt since 1882 and there was a permanent British military presence there to defend the Suez Canal which had been opened in 1869.

The 1st East Yorkshires had been fighting in the First Boer War in South Africa from 1888 until May 1893. At the end of May they arrived in Alexandria and the Ras-el-Tin barracks relieving the battalion of the South Staffordshire Regiment. Benjamin will have arrived before them.

Benjamin was promoted to Lance Corporal in the 1st East Yorkshires on 1 August 1893.5


     After being wounded he was treated at the Military Hospital. Benjamin died on Saturday, 23 December 1893 in the Military Hospital, Ras-el-Tin, Alexandria, Egypt.5 He was buried at the Rosetta Gate Cemetery, Egypt, on Thursday, 28 December 1893, aged 19 years.6

     There is a brass commemorative plaque with the regimental badge on the wall of Beverley Minster in memory of the 1st Battalion of the East Yorkshire Regiment 1885 – 1895.

     She was buried in All Saints Church, Trusley on Wednesday, 14 March 1900.
